1. Scope and provider

These terms govern the use of the website dzss.eu and the DZSS Server Studio software. The provider is Amir Herco (13PM NETWORK), Park Straße 6b, 85614 Kirchseeon, Germany.

By downloading or using the software you accept these terms. Deviating terms of the user do not apply.

2. Service

DZSS Server Studio is a Windows application for managing your own DayZ dedicated servers. The software is in beta and offered on this website as a free download. Nothing is sold through this website and no purchase contract is concluded.

3. Licence

Using the software to run your own servers is free of charge, including revenue from your own server operation (such as donations, premium slots or an in-game shop).

Anyone who uses the software to provide or manage servers for third parties for a fee (for example as a hoster or service provider) needs a separate agreement with the provider: dzss@kionova.com. In all other respects the licence file (LICENSE) shipped with every package applies.

4. Update check, no telemetry

Once per program start the software fetches the releases.json file from dzss.eu and compares the version listed there with the installed one. The sole purpose is the security and stability of your servers: an outdated server build rejects updated players, and security fixes should reach you.

No telemetry, usage or device data is transferred; there is no user account and no cloud. Only the usual web server log entry of that request occurs. An update is never installed automatically; whether and when you install it is your decision. Details are in the privacy policy.

5. Beta status and availability

The software is under active development; features and behaviour can change between versions. Make regular backups; the software ships its own tools for that. There is no claim to permanent availability of the website, the download or the update endpoint.

6. Warranty and liability

The software is provided free of charge. The provider is therefore liable for defects in quality or title only where a defect was fraudulently concealed.

Beyond that, the provider is liable without limitation only for intent and gross negligence and for injury to life, body or health; liability under the German Product Liability Act remains unaffected. Any further liability is excluded.

7. Obligations of the user

You use the software only within applicable law and respect the rights of third parties. Running DayZ servers is additionally subject to the terms of Bohemia Interactive, which remain unaffected by these terms. The licence boundary in section 3 must not be circumvented.

8. Trademarks

KIONOVA® is a registered trademark of Amir Herco (13PM NETWORK); DZSS Server Studio is a product designation of the KIONOVA® brand. DayZ is a trademark of Bohemia Interactive a.s.; this project is not affiliated with Bohemia Interactive. Details are in the legal notice.

9. Final provisions

German law applies. If you are a consumer, mandatory consumer protection rules of the state of your habitual residence remain unaffected.

Should individual provisions be invalid, the validity of the remaining provisions remains unaffected. The provider is neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
